Facts and the facts revealed rebel meeting held on 28 August 2012
Introduction

First. Confirmation of this we offer to you with this note and document facts and decisions of the meeting of rebels that followed the previous round of negotiations, held in August 28, 2012, accompanied by our observations and our intention is to provide automated information concerning the case to assist mechanism and facilitate its mission.

E. Rebels counting on tolerance and absolute flexibility of the mediation mechanism to enable them to procrastination and gain time and we expect to play a mediation role in clarifying the strong attitude toward this behavior.
And. Rebels betting exceeded the time limit of the Security Council procrastination and loss of time and deliberately seeking to frustrate the task of mediation, which means they go to bed is not negotiation.

7. كشــف حقائق ووقائـــع اجتمــــاع المتمردين المنعقد في 28أغسطــس 2012
مقدمــــة
وفاءً بالتزامنا المبدئي تجاه السلام كخيار سام ٍلتسوية النزاعات وبخاصة فى ولايتي جنوب كردفان والنيل الأزرق وحرصاً منا على تذليل مساعي الآلية الرفيعة الجادة لتحقيق السلام الشامل ، وتأكيداً لما قدمناه للآلية من رؤية فى الجولة السابقة والذي ضمناه مبادئنا ورؤيتنا ومنهجنا بغرض التسوية النهائية وإلحاقاً لما بيناه للآلية والمجتمع الدولي تجاه المتمردين والشكوك التي أوردناها منذ بداية المفاوضات والتي تؤكد أن المتمردين يفتقرون إلى الإرادة والرؤية والمنهج الأخلاقي للحلول السلمية ويرهنون إرادتهم لجهات أجنبية .
ومن الثابت أن من يختار الحوار والتفاوض عليه أن يتحلى بذلك سلوكاً وممارسة ويلتزم أخلاقياً داخل وخارج قاعات التفاوض وأن يجسد ذلك فكراً وتخطيطاً وممارسة وتعبيراً .
غير أن الذي نلاحظه ونلمسه فى سلوك المتمردين يؤكد عدم رغبتهم فى السلام والتفاوض كغاية وإنما يتخذون ذلك تكتيكاً لتحقيق مكتسبات مادية ومعنوية للتمكن من إطالة أمد الحرب فى الولايتين ومضاعفة معاناة المواطنين (الرهائن) فى المناطق التي يسيطرون عليها .
أولاً . تأكيداً لهذا فإننا نقدم إليكم مع هذه المذكرة مستند وقائع وقرارات اجتماع المتمردين الذي أعقب جولة المفاوضات السابقة والمنعقد فى 28 أغسطس 2012م مصحوباً بملاحظاتنا والتي قصدنا منها تزويد الآلية بالمعلومات المتعلقة بالقضية بغرض مساعدة الآلية وتسهيل مهمتها .
ثانيـاً . إن ما ورد فى اجتماع المتمردين اتسم بقدر من الاضطراب الفكري وتناقض واهتزاز المواقف هذا ما أكدته الازدواجية الواردة فى مسمى المتمردين لحركتهم وبمراجعة محضر الاجتماع نجد ثلاثة مسميات :
1. الحركة الشعبية لتحرير السودان .
2. الحركة الشعبية لتحرير السودان الشمال (فى النص الإنجليزي) .
3. الحركة الشعبية لتحرير السودان جبال النوبة فى خاتمة التقرير.
ثالثـــاً . المحضر أكد التناقض والازدواج والخداع الذي يمارسه المتمردون وهذا يؤكده عنوان الورقة التي قدمها المدعو ياسر عرمان فى الصفحة الأولى السطر الخامس قبل الأخير والتي حملت عنوان (الوضع السياسي وقضايا البناء والتفاوض وإسقاط النظام) هذا العنوان يعكس مدى التناقض والإزدواجية والخداع كما يؤكد أن المدعو ياسر عرمان لا يهتم بقضية جنوب كردفان والنيل الأزرق ولا تؤرقه معاناة أهلنا فى الولايتين وإنما أراد أن يجعل من القضية مطية ومعبراً لتحقيق أهدافه المرتبطة بالارتهان وإن جاءت على جثث ودماء وتشريد أهل الولايتين والذين لا يشكلون بالنسبة له غير وسيلة لتحقيق غاياته الشريرة .
رابعـاً . ورد فى السطر الخامس والسادس والسابع من الصفحة الثانية فى المحضر ما يلي (ثمن الاجتماع أداء قيادات الحركة الشعبية طوال عام ونصف من فك الارتباط وعام ويزيد من بداية الحرب الأمر الذي أوصل قضايا السودان والحركة الشعبية والولايتين لأعلى مؤسسة دولية (مجلس الأمن)) انتهى.
تعليـق . هذا النص يؤكد أن المتمردين أشعلوا الحرب بغية تصعيد القضية لمجلس الأمن واتخاذها وسيلة ضغط حسب اعتقادهم أنها حققت استجابة مجلس الأمن لمبتغاهم وفى ذلك نخشى أن يتمادى المتمردون فى الفهم المشوه ويستمروا فى استغلال أريحية الآلية والمجتمع الدولي لمزيد من الغطرسة والعناد متوهمين أنهم سيجدون الرعاية والحماية نتيجة فهمهم الخاطئ للقرار 2046 . أما الإشارة لفك الارتباط فإن السؤال الأهم متى كان ذلك وكيف والعالم كله يعلم أن المذكورين مازالوا أعضاء فى الحزب الحاكم فى الجنوب وضباطاً فى جيش دولة الجنوب .
خامساً . فى السطر (13) من الصفحة الثانية ورد النص الآتي (أكد الاجتماع أهمية وصواب شعار الاجتماع فى وحدة قوى المعارضة وإسقاط النظام نحو بناء دولة جديدة) انتهى.
تعليـق . فى هذا النص يستمر المتمردون فى ممارسة خداع الآلية الرفيعة والمجتمع الدولي فبينما يظهرون حرصهم على السلام والتفاوض عادوا ونقضوا ذلك فى التآمر مع الآخرين لإسقاط النظام حرباً وهم يتظاهرون بالحوار والتفاوض وفى هذا غدر وخيانة لجميع الأطراف بما فى ذلك الآلية الرفيعة . وكيف يمكن الوصول لسلام مع من يريد توسيع دائرة الحرب ويناقض منطوق القرار الأممي 2046 والذي يدعو لوقف الحرب والكف عن تلقي الدعم عبر الحدود لزعزعة الأمن والاستقرار فى البلد الآخر .
سادساً . ورد فى الصفحة الثانية السطر (28) (قرر الاجتماع استجابة لمطالب النازحين أن لا سيادة وطنية وأن الوفد التفاوضي للحركة الشعبية يجب أن يضع فى سبتمبر القادم عند مراجعة الاتفاق ..... نقل الطعام عبر حدود من دولتي جنوب السودان وإثيوبيا) انتهى.
تعليـق . هذا القرار يؤكد خروج المتمردين عن المواثيق والعهود ورفضها خاصة عندما تتعارض مع أهدافهم ومخططاتهم. فبينما استجاب وفد الحكومة لرغبة الآلية ومندوب الأمم المتحدة بالتوقيع على الاتفاق حول الشأن الإنساني والذي جاء ملبياً للاتفاقية الثلاثية ومبادئها العامة المبنية على السيادة الوطنية فإذا بالمتمردين يعارضون ذلك فى اجتماعاتهم وقراراتهم متطلعين إلى استجابة الآلية والشركاء الثلاثة لنقض الاتفاق مؤكدين بذلك أن هدفهم من المساعدات الإنسانية لم يكن لخدمة المواطنين وإنما اتخاذه وسيلة لتلقي الدعم المادي والعسكري من أعوانهم ومناصريهم بغرض إطالة أمد الحرب وترويع الآمنين وخلق ظروف إنسانية تزيد من معاناة المواطنين الأسرى لدى التمرد . وفى ذلك نؤكد أن أمر المساعدات الإنسانية قد حسم بتوقيع الاتفاق وعلى جميع الأطراف الشروع فى تنفيذ بنوده لفائدة المواطنين ولن نقبل أي فتح لهذا الملف مرة أخرى ولن نقبل حوله إلا ما اتفقنا ووقعنا عليه كما نطلب من الآلية توضيح أسباب تأخر تنفيذ بنود اتفاق المساعدات الإنسانية وإعلان من تسبب فى ذلك واتخاذ موقف واضح تجاهه .
سابعاً . ورد فى الصفحة الثالثة السطر الثالث تحت الرقم (3) (ستطلب الحركة الشعبية من الآلية الرفيعة السماح لها بإجراء مشاورات مع القوى السياسية والشخصيات الفاعلة المعارضة للنظام فى الولايتين وعلى رأسهم قوى الإجماع الوطني ولاسيما الأحزاب المعارضة التي شاركت فى انتخابات الولايتين) انتهى .
تعليــق
1. هذا القرار يؤكد عزلة المتمردين وانقطاع تواصلهم السياسي والاجتماعي مع مجتمع الولايتين ويريدون من الآلية أن تصبح وسيلة لاستعادة وصلهم بالمجتمع .
2. هم يجهلون أن قوى مجتمع الولايتين السياسية والاجتماعية قد توحد رأيها الرافض للحرب واختارت السلام منهجاً لتسوية قضية الولايتين وقد سبق أن زودنا الآلية الرفيعة بالميثاق الممهور بتوقيع القيادات السياسية والاجتماعية فى الجولة السابقة.
3. إن وفد الحكومة وتأكيداً لمبدأ توسيع المشاركة والمشاورة لأصحاب المصلحة المباشرة ، أضاف فى هذه الجولة ممثلين للقوى والأحزاب السياسية بالولايتين وفيهم السيد دانيال كودي أنجلو رئيس حزب الحركة الشعبية (جناح السلام) والسيد سراج علي حامد رئيس حزب الحركة القومية للسلام والتنمية والسيد باكو تالي رمبوي رئيس الحزب القومي السوداني المتحد والأستاذ منير شيخ الدين رئيس الحزب القومي الديمقراطي الجديد والسؤال يطرح نفسه إذا كان وفد الحكومة قد ضم كل هذه القيادات والأحزاب مضافاً إليهم أولئك الموقعين على الميثاق الذي تم تسليمه للآلية فى الجولة السابقة فعن أي أحزاب يتحدث هؤلاء أم أنهم يجهلون مكونات مجتمع الولايتين وبذلك يؤكدون عزلتهم .
ثامناً . ورد فى الصفحة الثالثة السطر (18) (كلَّف الاجتماع رئيس هيئة الأركان وهيئته بإعادة هيكلة الجيش الشعبي كجيش تحرير وطني واتخاذ كآفة الخطوات الرامية لذلك وإكمال الاستعدادت لهزيمة مخططات المؤتمر الوطني فى الصيف القادم) انتهى .
تعليـــق . هـذا القـرار يؤكـد الآتــي :
1. عدم الالتزام الأخلاقي بأدب الحوار والتفاوض وخداع أطراف التفاوض بما فى ذلك الوساطة كما يؤكد السلوك العدواني للمتمردين .
2. هذا القرار يناقض أحد المبادئ الأساسية التي اعتمدتها الآلية فى الجولة السابقة وهي وجود جيش وطني واحد تأكيدا لمبدأ سيادة الدولة ومسئوليتها الدستورية .
3. برغم مشاركة المتمردين فى المفاوضات والتزاماتهم السابقة إلا أنهم يؤكدون ما يضمرون من سوء نية بإشارتهم الصريحة بالإعداد للحرب فى الصيف القادم .
تاسعاً . ورد فى الصفحة (3) السطر (24) (دعوة قيادة الحركة الشعبية للإسهام بفاعلية فى الحملة الداخلية والخارجية للوقوف مع أهل دارفور وحيا جماهير وطلاب نيالا ورهيد البردي) انتهى .
تعليــق . مازلنا نؤكد أن قيادات التمرد مهتمة بقضايا لا علاقة لها بمعاناة أهل الولايتين . فبينما هم عاجزون عن تقديم ما يخدم أهل الولايتين يقفزون إلى قضايا حسمت من جانب أهلها بالحكمة مثل أهل دارفور ويريدون أن تعود دارفور لمربع الحرب مجدداً، دون احترام للإرادة الإقليمية والدولية التي سهرت للوصول لحل نهائي لمشكلة دارفور أشركت فيه كل أهل المصلحة.
عاشراً . فى الفقرة الأخيرة من التقرير والمتعلقة بعلم المتمردين تؤكد هذه الفقرة عدم القدرة على التحرر من الأسر والارتهان هذا ما تؤكده ألوان ورموز العلم .
حادي عشر . خلاصة رأينا فى ما صدر من بيان لحركة التمرد أنها حركة تتسم بالآتي :
1. اضطراب الفكر وانعدام الرؤية والمنهج لدى المتمردين .
2. إستمرارها فى استغلال أرض وشعب الولايتين كأدوات ووسائل لخدمة أغراضهم وأهدافهم التي لا علاقة لها بمصالح مجتمع الولايتين .
3. الاستخفاف بالمجتمع الدولي والتمادي فى الخداع بغرض كسب الوقت وإطالة النزاع وزيادة معاناة أهل الولايتين .
خاتمــة . نختم هذه المذكرة بتأكيدنا للآتي :
1. التزامنا المبدئي بالحوار سبيلاً للتسوية النهائية لقضية الولايتين مع أطراف مسئولة وقادرة على احترام التزاماتها والوفاء بها ومتفهمة لدور المجتمع الدولي والإقليمي.
2. التزامنا بكل المواثيق والعهود المقدمة من قبلنا فى الجولات السابقة ونطالب الوساطة ببيان الحقائق وكشف تلاعب حركة التمرد واستهتارها وعدم التزامها .
3. حرصنا التام لمواصلة التفاوض والحوار وتقديم الرؤية الواقعية للتسوية النهائية للقضية.
4. تأكيد التمسك بالمبادئ والمرتكزات المقدمة من قبلنا فى الجولة السابقة والتي وجدت القبول من الآلية الرفيعة فى اجتماعنا معها بتاريخ 31/7/2012م .
5. إن وفد الحكومة بتشكيله الحالي يؤكد التمثيل الشامل لمكونات مجتمع الولايتين الاجتماعية والسياسية وأن لدينا وسائل تحقيق رضا وموافقة أصحاب المصلحة المباشرة ونرجو من الوساطة استصحاب هذا البعد فى البحث عن طريق آمن للوصول إلى تسوية نهائية.
6. كما أننا نؤكد للآلية والوساطة لمعرفتنا الدقيقة بالمتمردين أنهم:
أ. لا يمتلكون الإرادة ولا الرؤية ولا المنهج الأخلاقي للتفاوض للوصول لحل سلمي نهائي .
ب. عدم استطاعة المتمردين التخلص من الأسر والارتهان والتقيد بالأجندة الخارجية وعدم القدرة على فك ارتباطهم السياسي والعسكري بدولة الجنوب .
جـ. استمرار المتمردين فى استغلال قضية الولايتين كمطية ومعبر لتحقيق أجندة لا علاقة لها بالقضية ولا بأهلها وإن أدى ذلك لمزيد من المعاناة للمواطنين المدنيين العزل .
د. استمرار المتمردين فى النكوص عن المواثيق والاتفاقيات وتعطيل تنفيذها بدءاً باتفاق المساعدات الإنسانية .
هـ. يعوَّل المتمردون على التسامح والمرونة المطلقة للآلية والوساطة لتمكينهم من التسويف وكسب الوقت ونتوقع أن تضطلع الوساطة بدورها فى توضيح موقف قوي تجاه هذا المسلك .
و. يراهن المتمردون على تجاوز المدة المحددة من مجلس الأمن بالتسويف وضياع الوقت ويسعون عمداً لإفشال مهمة الوساطة ، ما يعني أنهم يبيتون أمراً غير التفاوض .
ز. يتوهم المتمردون أن مجلس الأمن سيتخذ قرارات فى مصلحتهم فى حالة تجاوز المدة المحددة وندرك أن حصافة الوساطة وامتلاكها للمعلومات الكاملة سيمكنها من كشف هذا المخطط وإفشاله .
7. من كل ذلك نأمل من الآلية الرفيعة والوسطاء حزم وضبط سلوك المتمردين وإلزامهم بالمنهج الواقعي للتفاوض حرصاً للوصول إلى نتائج مثمرة للمفاوضات وحملها على فك أسر المواطنين وإيقاف التجنيد القسري لأطفالهم والكف عن الحديث المستمر عن الأجندة الحربية والاستهانة بجهود الوساطة والمجتمع الدولي .
